File Form IT-203-A with your New York personal income tax return. Use it as an attachment to Form IT-201 or Form IT-203 when business income, business loss, or self-employment earnings must be allocated between New York State and another place, or between the MCTD and another place. Complete the schedule before entering the final allocated amounts on your main tax return. If the form does not give you enough space, prepare an extra sheet with the same details and attach it with the form. Use Schedule A to list every place where you carry on business, both inside and outside New York State, or both inside and outside the MCTD zone selected.
1, Street Address: Enter the street address of each business location. Include all locations where the business operates, not only New York locations.
2, City And State: Enter the city and state for each business location listed on the same row.
3, Description: Briefly describe what happens at that location. For example, you may describe it as an office, store, warehouse, job site, service location, administrative location, or other business place.
Additional Business Location Lines: Use each available row to list another business location. If you have more locations than the form allows, attach another sheet with the same three details: street address, city and state, and description.
Income Or Net Earnings From Self-Employment Determined From Books: Check this box if your business records clearly show the part of your income or net self-employment earnings that comes from New York State or the selected MCTD zone. When your books clearly separate the income, you may use the amount shown by your records instead of relying only on the formula method.
Schedule B, Formula Basis Allocation
Use Schedule B when your books do not clearly show the portion of business income from New York State or the selected MCTD zone. This section uses property, payroll, and gross income to create a business allocation percentage.
Column A, Totals In And Out Of New York State Or MCTD: Enter the total amount for each factor everywhere the business operates. This means both inside and outside New York State, or both inside and outside the selected MCTD zone.
Column B, New York State Or MCTD Amounts: Enter the portion of each factor that belongs to New York State or the selected MCTD zone.
Column C, Percent: Divide Column B by Column A for each applicable line, then enter the result as a percentage. This shows what part of the total factor belongs to New York State or the selected MCTD zone.
Items Used As Factors: Use this part to calculate the allocation factors. These factors are property, payroll, and gross income.
Property Percentage: Lines 1 through 4 are used to calculate the property percentage. This compares New York or MCTD property to total business property.
Line 1, Real Property Owned: In Column A, enter the total value of real property your business owns everywhere. In Column B, enter the part located in New York State or the selected MCTD zone. Real property usually means land and buildings owned by the business.
Line 2, Real Property Rented From Others: In Column A, enter the total value or rental amount for real property your business rents everywhere. In Column B, enter the portion for rented real property located in New York State or the selected MCTD zone.
Line 3, Tangible Personal Property Owned: In Column A, enter the total amount of tangible personal property owned by the business everywhere. In Column B, enter the amount used or located in New York State or the selected MCTD zone. Tangible personal property can include equipment, furniture, machinery, tools, or similar physical business property.
Line 3a, Tangible Personal Property Rented From Others: In Column A, enter the total amount for tangible personal property rented from others everywhere. In Column B, enter the portion used in New York State or the selected MCTD zone.
Line 4, Property Percentage: Add lines 1, 2, 3, and 3a in Column A. Then add lines 1, 2, 3, and 3a in Column B. Divide the Column B total by the Column A total and enter the result in Column C as the property percentage.
Line 5, Payroll Percentage: In Column A, enter total payroll for the business everywhere. In Column B, enter the payroll connected to New York State or the selected MCTD zone. Divide Column B by Column A and enter the percentage in Column C.
Line 6, Gross Income Percentage: In Column A, enter total gross income from the business everywhere. In Column B, enter the gross income connected to New York State or the selected MCTD zone. Divide Column B by Column A and enter the percentage in Column C.
Line 7, Total Of Percentages: Add the percentages from lines 4, 5, and 6 in Column C. Enter the total percentage on line 7.
Line 8, Business Allocation Percentage: Divide the line 7 total by three if you used all three percentages. If fewer than three percentages apply, divide by the actual number of percentages used. Enter the result on line 8. This is the percentage used to allocate business income or net earnings.
Line 9, Allocation Of Business Income To New York State
Use line 9 to calculate the New York State amount for each business income or loss item from Form IT-203 that must be allocated.
Line 9, First Line Number: Enter the line number from Form IT-203 where the business income or loss item is reported in the Federal amount column.
Line 9, First Dollar Amount: Enter the federal amount of that business income or loss item.
Line 9, First Percentage From Line 8: Multiply the federal amount by the business allocation percentage from line 8.
